Welcome to the Terms and Conditions of Use of Bitcoin ATMs of Virtual Planet Ltd. (VirtualPlanet). Here you will find all the legal principles and operational instructions that VirtualPlanet Ltd. (hereinafter referred to as the "Company") provides to explain under what conditions you use our Bitcoin ATMs (hereinafter referred to as the "ATMs").We appreciate our customers (hereinafter referred to as the "Customer") and always strive to provide the best possible service for buying and selling cryptocurrencies at our ATMs.

However, we want to make clear the details of the use of our services (hereinafter referred to as "Services") that every customer should know.

By using our ATMs, you accept these Terms of Use and confirm, among other things, that you fully own and control the cryptocurrency wallet and funds you wish to use at our ATMs.

Please read these Terms of Use carefully, as they contain the arbitration agreement and other important information regarding your rights, remedies and legal obligations. The arbitration agreement requires (with limited exceptions) that you submit all claims against us and other indemnifying parties to binding and final arbitration, and further: (1) you may only bring claims on an individual basis and not as a member of a class or group, (2) you may only pursue claims on an individual basis, and (3) your claims will not be able to be tried by jury or court.

You agree that you may bring claims against the company or any other indemnifying party only individually and not as a member of a class or group. Unless you and the company agree otherwise, the arbitrator may not combine more than one person or one party's claims. The arbitrator may award damages (including monetary damages, injunctions and declaratory relief) only for the benefit of the party bringing the claim and only to the extent necessary to provide relief arising from that party's individual claims. Nevertheless, you may bring public claims in accordance with applicable law.

All transactions made through our ATMs (blockchain-based payments) are final and irreversible. The company is not responsible for the money you use to purchase cryptocurrencies or the address of the wallet to which these cryptocurrencies are transferred. Any fraudulent or criminal transactions are illegal and may result in loss of money or cryptocurrencies. The company is not responsible for unauthorized or erroneous transactions made by you or another person.

Beware of scams!
The rule of thumb is not to buy or send cryptocurrencies to people you don't know and have never met before.

If you find yourself in the following situations, you should consider the possibility that you are a victim of crime:

  • Romantic fraud (the most common scam): Have you been sent to a Bitcoin ATM to send money to your boyfriend, girlfriend, fiancé, husband or wife whom you met online? It's probably a scam. We don't want to worry you, but in such a situation, that person is probably lying in an attempt to get you to send them cryptocurrency that you will never get back. Scammers manipulate emotions and promise love in order to seize your money. Do not trust them and do not send any funds to the address they provide! You can contact our support line to discuss the situation. Protect yourself now instead of regretting the loss later.
  • Job scam: Sometimes a new employer may say they will deposit money into your bank account, and then ask you to withdraw those funds and send them via Bitcoin ATM to the address you provided. This is another scam, and when you withdraw the money and transfer it at the ATM, you will find that the funds you received came from a hacked bank account and will be returned to the original owner, leaving you with a deficit in your account. Basically, you use your own money, convert it to cryptocurrency and send it to the address provided. That cryptocurrency gets stolen. As previously mentioned, all transactions are irreversible and you will not be able to get your money back. You will never hear from the person who offered you the job again.
  • Fraudulent purchase of goods using cryptocurrencies: Sometimes on online platforms such as Ebay, OLX or Facebook Marketplace, you may find an offer to sell an item at a slightly lower price than others. The only catch is that the seller wants you to pay with cryptocurrency, such as using a Bitcoin ATM. However, once you send the cryptocurrency to the address provided, the seller disappears with your money and, of course, you won't receive the purchased item.

These three examples show why sending money to unknown people (especially when they promise you something, such as love, a cheap item or a job) can end badly for you. Don't hesitate to learn more about the different types of scams, and if you have any doubts, contact legal authorities to make sure the transaction you are conducting is safe and in your best interest.

Disclosure of significant risks associated with the Services

  • Cryptocurrencies are not legal tender, are not backed by any government or financial institution, and are not subject to any protections.
  • Legal and regulatory changes at the national or international level may adversely affect the use, transfer, exchange and value of cryptocurrencies.
  • Cryptocurrency transactions are irreversible, so losses resulting from fraud or erroneous transactions cannot be recovered.
  • Cryptocurrency transactions are considered to have taken place when they are recorded on the public blockchain ledger, which is not necessarily the date or time the customer initiated the transaction.
  • The value of a cryptocurrency may depend on the willingness of market participants to exchange fiat currencies (such as the U.S. dollar or the euro) for cryptocurrencies, which could lead to a complete and permanent loss of value of Bitcoin or cryptocurrencies if the market collapses.
  • There is no assurance that any person who accepts cryptocurrency as payment today will do so in the future.
  • The volatility and unpredictability of cryptocurrency prices relative to fiat currencies can lead to significant or total losses.
  • The nature of cryptocurrencies as an Internet protocol can increase the risk of fraud or cyberattacks.
  • VirtualPlanet.gr does not guarantee the availability of the Service.

Risk of Loss
Customer assumes the full risk of owning Bitcoin or other cryptocurrencies and acknowledges that Bitcoin is a volatile asset and cryptocurrencies are a volatile asset class. Bitcoin and other cryptocurrencies are not subject to regulatory protection and are not insured or guaranteed by VirtualPlanet.gr or any other party. VirtualPlanet.gr is not an investment advisor and does not provide any advice or guidance on the suitability of owning Bitcoin or similar cryptocurrencies. VirtualPlanet.gr is not responsible if the price of cryptocurrencies drops after the purchase made by the Customer.

VirtualPlanet.gr is not responsible for the safe storage of the Customer's cryptocurrencies after their purchase or fiat currencies after the sale of cryptocurrencies.

VirtualPlanet.gr is not a provider of cryptocurrency wallets. To access the Service, you may be required to use a cryptocurrency wallet provided by a third party. You must use your own cryptocurrency wallet. You are not entitled to use a cryptocurrency wallet belonging to another person or a third party. If VirtualPlanet.gr recommends or requires the use of third-party wallet applications to store Bitcoin or other cryptocurrencies, it is the sole responsibility of the Client to investigate these applications before using them. The Company does not control or take responsibility for such third-party provided wallets and cannot provide technical support or customer assistance in case of problems with the use of such wallets. Full responsibility for the security of the wallet used in conjunction with the Service rests with the Client. VirtualPlanet.gr is not responsible for the operation of such wallets or for the security of cryptocurrencies sent to or from a third party wallet.

VirtualPlanet.gr operates Bitcoin ATMs for personal use only. You are not allowed to make transactions on behalf of another person or use any identity documents other than your own. If someone asks you to make a transaction on their behalf, please contact our support line at +48 728 008 004 or the number assigned to your country.

You assume full responsibility for the security of your fiat money, cryptocurrenciesand any cryptocurrency wallets.

Transactions and Restrictions
Subject to these Terms of Use, the Service is designed to allow you to buy and sell Bitcoin and other cryptocurrencies at any location of a Bitcoin ATM owned and operated by VirtualPlanet.gr. You must be physically present at a Bitcoin ATM owned and operated by VirtualPlanet.gr to conduct a transaction. You may not use or access the Service at any ATM or any other location that is not owned or operated by VirtualPlanet.gr. The Service is not accessible via the Internet.

Transactions can only be made in a few currencies, usually your country's main currency or in euros and cryptocurrencies supported by the company. The supported cryptocurrencies may change from time to time.

All transactions are irreversible and non-refundable. You do not have the right to withhold payment for any transaction. The ATM may provide you with a confirmation of the transaction. Keep this confirmation for your records.

The Company may, at any time, limit the amount of any transaction that the Customer may conduct and impose daily and/or monthly transaction limits on the Customer's use of the Service. These limits may be changed at any time for any reason at the Company's sole discretion, with or without notice. Using multiple wallets or another person's identification information to circumvent these limits is strictly prohibited and may result in suspension of your use of the Service. The Company has the full right to close or suspend your account at any time and for any reason permitted by law. The Company also has the full right in its sole discretion to reject any transaction request for any reason.

We may also impose a block on any assets deposited at an ATM if we believe, in our sole discretion, that the requested transaction is suspicious or violates the law or these Terms of Use. We may refuse to release the blockade on such funds as long as we deem appropriate to complete our investigation of the activity or source of such assets. Funds may be frozen, blocked or transferred to a regulatory authority if required by applicable law, by order, warrant or request of a regulatory authority, or if necessary for the Company to comply with its legal obligations.

Fees
VirtualPlanet.gr prides itself on offering some of the lowest Bitcoin ATM fees in the world.

You agree that VirtualPlanet.gr may charge fees ("Transaction Fees") and you will pay above market price (hereinafter: Market Price) up to approximately 5.7% for purchases and receive approximately 4.8% below Market Price for selling cryptocurrencies. "Market Price" means the actual market price of the traded cryptocurrency at the time it is transacted by VirtualPlanet.gr, at the sole discretion of VirtualPlanet.gr. Sometimes, due to special offers, the commission for selling cryptocurrencies may be 0%.

VirtualPlanet.gr uses its own "exchange rate server" (which takes into account the average of multiple cryptocurrency exchanges) to determine the Market Price. VirtualPlanet.gr reserves the right to use another source without notice to determine the Market Price for any reason. By transacting with VirtualPlanet.gr, you waive any claim or liability to VirtualPlanet.gr regarding the manner in which the Company determines the Market Price. VirtualPlanet.gr also charges a small Network Fee (minimum PLN 0.01 or equivalent in your country) (hereinafter: "Network Fee"). The Network Fee refers to the required payment for using the corresponding blockchain to send the selected cryptocurrency to your cryptocurrency wallet. Customers can increase this Network Fee by using the slider on the screen to speed up transaction processing and reduce the time it takes for the cryptocurrency to appear in the wallet. During periods of high transaction load, the Network Fee may be increased. By making a transaction with VirtualPlanet.gr, you waive any claim or liability to the Company regarding the Network Fee charged.

The Transaction Fee is calculated as a percentage above the Market Price, as described in the paragraph above. The Transaction Fee and Network Fee are included in the exchange rate applicable to your transaction. We will inform you of the exchange rate applicable to your transaction before you make the transaction. In other words, VirtualPlanet.gr will tell you: (1) the amount of cryptocurrency that you will receive from VirtualPlanet.gr in exchange for the fiat currency you have deposited, and (2) the amount of fiat currency that VirtualPlanet.gr will pay you for the specified amount of cryptocurrency (provided that the cryptocurrency is sent to the wallet address provided by the Company within ten minutes of placing the order). By entering into a transaction, you agree to the exchange rate, including the Transaction Fee and Network Fee, and accept the other terms and conditions applicable to the transaction in accordance with these Terms of Use. If you do not agree, you cannot proceed with the transaction and must immediately stop using the ATM for that transaction.

VirtualPlanet.gr reserves the right to change its Transaction Fees. You understand and agree that all VirtualPlanet.gr ATMs may not charge the same Transaction Fees. By making a transaction, you acknowledge that you have been informed of the exchange rate applicable to your transaction and that you have agreed to that rate, including the Transaction Fee and the Network Fee.

Customer Eligibility for the Service
In order to combat terrorist financing and money laundering, we may be required by law to obtain, verify and record the identifying information of any Customer who uses or wishes to use the Service. This is known as the KYC (Know Your Customer) verification process and is mandatory in some countries where we operate, or when a customer exceeds the AML limit in a country. This means that when you submit a transaction request at any of our Bitcoin ATMs, the following personal information may be collected (although this varies depending on the laws of the countries): name, address, date/place of birth, nationality/citizenship, type/number of identity document, issuing authority, a copy of the image of the identity document provided, and a facial photo, as well as time-stamped video recordings and data on transactions made. In any case, the Company collects: facial photo, time-stamped video recordings and data on transactions carried out. The requirements for collecting identification information may change at any time and for any reason. All of the above data is processed and may be transferred to the relevant government authorities. You may be required to complete this identity verification process to the satisfaction of the Company in order to access and use the ATM or certain features of the Service. You agree to provide true, accurate, current and complete information about yourself. Even if you have previously verified your identity, we may request additional information to allow you to re-verify your identity. This may occur at any time. We may refuse to process a transaction if we cannot verify your information or if you do not provide the required identification documents.

If you are a minor in your country, you are not authorized to use the Service. The Company does not accept organized entities or registered as Customers of the Service. The Service is intended for personal use only. The purpose of using the ATM is declared by you as personal and investment. The Company reserves the right to reject any person as a Customer of the Service for any legitimate reason.

You do not have the right to use a cryptocurrency wallet belonging to another person or third party. As a customer, you agree to use only your own cryptocurrency wallet for all transactions.

Data storage
Data is collected exclusively by VirtualPlanet.gr, which uses the data only to the extent necessary for proper identification. Data is stored for a maximum of 10 years from the date of each transaction due to legal requirements (data retention requirements and limitation periods for potential legal claims). This period can be about 5 years, depending on the country. In addition, we process the date of each transaction, the amount of the transaction and assign each transaction an internal identification number to keep a proper record of each transaction in our system. All the information collected above is stored in a distributed network of servers, the location of which we reserve the right to keep confidential for safety and security reasons.

VirtualPlanet.gr will take all appropriate technical and organizational measures to ensure that only personal data whose processing is strictly necessary for business purposes will be processed. We use these measures to ensure that personal data will be accessible to a limited and necessary number of persons and to regulatory authorities in accordance with applicable laws. Other individuals will not have access to personal data under any circumstances without the express consent of the data subject.

All VirtualPlanet.gr employees have been sufficiently informed of all applicable data protection laws, internal data protection regulations, as well as data security precautions, and are required to maintain the confidentiality of all information entrusted to or shared with them within the scope of their employment. Data protection requirements are strictly adhered to, and personal data is shared with individual employees only to the extent necessary in view of the purpose of data collection and our resulting obligations. If data processing is outsourced to an external entity, it is subject to compliance with all applicable data protection regulations under certain framework agreements. In addition, when processing your (personal) data, they shall strictly comply with our specifications, especially with regard to the type and scope of processing.

VirtualPlanet.gr will never unnecessarily share your data with any unauthorized or unnecessary third parties.

Most common mistakes made by customers at our ATMs
When presenting your ID to our ATMs, remember to hold your ID flat on the ID card reader/scanner (not in front of the QR code reader) without touching the screen with your fingers. Hold the ID for about 10 seconds without moving. If you require the other side of the ID to be scanned, a message will appear on the home screen asking you to turn the ID over and hold the other side on the reader again for about 10 seconds. This time allows the scanner to focus accurately and get a good image of your ID so that the transaction can go smoothly.

When selling (sending) Ethereum, only ERC20 tokens can be successfully received by VirtualPlanet.gr. You can also check at https://etherscan.io/ whether the transaction will go through (you can check the type of Ethereum you intend to send by copying the public address - TXID/hash of 64 characters - of the funds and pasting it into the search engine at https://etherscan.io/ to see if there are any funds associated with this transaction, in this case Ethereum. If there is no value associated with this hash, the transaction will not be processed by VirtualPlanet.gr). Most Ethereum sales transactions will go through without a problem, except in a few specific cases, such as when you send Ethereum from your Binance wallet, where Ethereum is sent as a Binance-Peg Ethereum token. In short, only ETH sent via ERC20 will be processed.

Another common problem with sales transactions occurs when a customer uses the online transaction gas pedal or the "accelerate" option on the exchange/wallet to try to speed up the transaction. If this happens, contact support immediately, as there may be a double spend ("double spend"), meaning that VirtualPlanet.gr will receive two payment confirmations, both of which will be deemed unsafe and rejected by the Company. By calling the support department and providing the transaction code displayed on the bottom half of the ATM printout for this sales transaction, we will be able to resolve the problem.

When you buy cryptocurrency from us, you will immediately receive a receipt that states the amount of cryptocurrency you will receive to your wallet. Depending on the network fee you selected when making the transaction, you will have to wait a certain amount of time for the funds to arrive. You can check this by going to your wallet and seeing if the cryptocurrency has arrived. If not, you should call support and ask what happened, providing your wallet address so we can easily track your funds. If you lose your receipt, don't worry, you can call our support team and give them your wallet address to check the status of the transaction.

When selling cryptocurrency, if you enter the amount you want to receive in fiat currency on the screen (without selecting the "show QR code" option), you will receive a printout with the QR code displayed (at the top of the printout) of the wallet address to which you must send the cryptocurrency. You have 10 minutes to send this amount of cryptocurrency to get the exchange rate shown on the printout, and thus the amount of fiat currency that is written on the printout. If you send any amount of your chosen cryptocurrency to this address after these 10 minutes, the exchange rate may be different, and thus the amount paid to you may differ from the amount shown on the printout. After sending the cryptocurrency, you can scan the barcode at the bottom of the printout to verify that we received and authorized the transaction. If we haven't, you have the option to enter your phone number, which will be called by one of our operators to let you know when your money is ready to be collected from our ATM. It is always advisable to keep the printout with the QR code, as it contains a transaction code that we can use to track your transaction in our system. When you collect your money (for selling cryptocurrency), you will receive a transaction confirmation from the ATM.

It is always advisable to keep all receipts, as their absence can make it difficult for our operators to track transactions.

Customer Responsibilities
The customer is solely responsible for verifying the accuracy of the information entered when using the service, including but not limited to the amount of the transaction requested, the type of currency or cryptocurrency to be exchanged and transferred, and the address of the cryptocurrency wallet to or from which the cryptocurrency will be transferred. The details of the cryptocurrency wallet address displayed on the order summary page will be the final transfer location. By requesting an ATM transaction, you authorize us to process the transaction according to the information you have entered, which is shown to you on the order summary page. In the event that this information is incorrect and funds are transferred to an unintended address, the company will not refund the customer or be responsible for any losses. Therefore, the customer must make sure that the cryptocurrency address they enter or scan is correct. If we believe that any error has occurred in connection with a transaction made at a VirtualPlanet.gr ATM, you hereby authorize and agree to provide us with all information and resources required by VirtualPlanet.gr to correct the error so that the correct amount is transferred between VirtualPlanet.gr and the customer.

Customers agree not to use the service to engage in any unauthorized or unlawful activity, including but not limited to money laundering, drug trafficking, human trafficking, tax evasion, or terrorist financing, or to engage in any activity that would adversely affect the operation of ATMs or violate these Terms of Use. Suspicion of use of the service for unauthorized or illegal activities or violation of these Terms of Use shall be grounds for suspension of the Customer's access to the service; whether such suspicion is reasonable is solely at the absolute discretion of the Company.

Any form of mechanical violence on the part of the user is prohibited and treated as damage to property. Even in the case of awkwardness or unintentional damage, the user who caused the damage is liable. The ATM user is not allowed to touch or adjust the installation of surveillance cameras. In case of violence or attempted theft, the prosecutor will be notified.

Customers agree to respond to all inquiries from the Company regarding Customer transactions; failure to respond to Company inquiries may result in suspension of all future transactions and blacklisting.

The decision to conduct any transaction using ATMs, and any profit or loss resulting therefrom, is the sole responsibility of the Customer. The Customer is responsible for any sales, use, value-added or similar taxes that are imposed in connection with the use of our services. We reserve the right to collect or recover such taxes from the Customer at any time when required or permitted by law.

Communications
We record and/or monitor all of our phone calls and messages with you. If we record, we do not have to keep the recordings unless we are required by law to do so. If you provide us with your cell phone number, you give us permission to contact you at that number regarding your account and transactions.

The Company makes no warranties, express or implied, with respect to the Service, including without limitation any express or implied warranties of merchantability or fitness for a particular purpose.

Some EU laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply and you may have additional rights.

You agree that we, our service providers, operators, officers, directors and employees (and those same employees, service providers, subsidiaries and affiliates) (each, an "Indemnified Party" and collectively, the "Indemnified Parties") will not be liable for any action we take when we follow your instructions. In addition, the Indemnified Parties will not be liable if any Indemnified Party fails to follow your instructions, if we believe that your instructions expose us to potential loss or civil or criminal liability, or are contrary to common banking practices. To the extent you are entitled to indemnification under this Agreement, the Indemnified Parties' total liability to you will not exceed EUR 500, unless otherwise required by applicable law. The Indemnified Parties will not be liable for indirect, special or consequential damages, regardless of the form of action, even if we have been informed of the possibility of such damages. This paragraph will survive the termination of your account and use of the service.

VirtualPlanet.gr is not responsible for any changes in the Internet connection, be it a reduction in the speed of the service or the unavailability of the service for any period of time. Customers acknowledge that an account may be suspended for any reason and that they may not be able to access the service at any time for any reason.

Indemnification
You agree to indemnify and hold harmless the Indemnified Parties from any and all losses resulting from your use of the Services, except for losses resulting from gross negligence or willful misconduct on our part. You further agree to indemnify and hold harmless the Indemnified Parties from losses resulting from actions taken or omitted in good faith by the Indemnified Party based on instructions from you. The Indemnified Parties shall not be liable for any acts or omissions of any third party. If you give us instructions that we believe may expose us to potential liability, we may refuse to follow those instructions and we will not be liable to you if we refuse to follow them. If we choose to follow your instructions, we may require you to provide certain safeguards, such as a warranty or an indemnification agreement in a form that is satisfactory to us. This clause will continue to apply even after your use of the services is terminated and your account is closed.

Force Majeure
VirtualPlanet.gr shall not be liable for any delay, inactivity or interruption of service that results directly or indirectly from any cause or condition beyond our reasonable control, including, but not limited to, significant market volatility, any act of God, act of civil or military authority, acts of terrorists, riot, war, strike or other labor dispute, fire, interruption of telecommunications or internet services, hardware and/or software failure, labor shortage, pandemic, government regulation or other disaster, or any other event beyond our reasonable control. These circumstances do not affect the validity and enforceability of any other provisions.

Miscellaneous Provisions
If we do not exercise our rights or delay exercising them in accordance with these Terms of Use, this does not mean that we give up those rights or that we lose the right to exercise them in the future.

Unless prohibited by the applicable laws of the country in which we operate, we may change these Terms of Use, including fees and service features, at any time. We may notify you of changes by posting a new version of these Terms of Use on our VirtualPlanet.gr website or by presenting them to you at the time you apply for an ATM transaction. If we have notified you of the change to the Terms of Use and you continue to use the service after the effective date of the change, you are deemed to have accepted the change. If you do not accept the change, you must immediately stop using the service before the effective date of the change.

Regulations
The Company is registered as a Virtual Asset Service Provider in various countries and may be required by law to file currency transaction reports and/or suspicious activity reports with regulatory authorities with respect to Clients' activities. The Company may not inform Clients of the filing of such reports. The Company may also be required by law to provide information regarding the Client's transactions to other regulatory authorities. The Company shall have no liability to the Client for providing information to regulatory authorities regarding the Client's use of the Service.

The fee schedule may be changed at any time at our sole discretion. The Transaction Fee and Network Fee will be included in the exchange rate applicable to your transaction. The exchange rate, including these fees, will be disclosed to you prior to your transaction and will be charged to you when you agree to make the transaction. No cryptocurrency or any transaction made using the service is insured or guaranteed by any authority in Greece, Poland, the European Union or by private insurance against theft or loss, including digital theft or otherwise. Cryptocurrency transfer is irreversible, without exception. We are not responsible for any unauthorized, erroneous or accidental transfers made by you or any other person who has gained access to your account or wallet. The nature of virtual currency may lead to an increased risk of fraud or cyber attack, and your cryptocurrency may be irreversibly stolen.

Dispute Resolution Before Arbitration
The Company and the Indemnified Parties are always interested in resolving disputes in a friendly and efficient manner, and most customer problems can be resolved quickly and satisfactorily by contacting customer service at support@virtualplanet.gr. If such efforts prove unsuccessful, the party intending to seek arbitration must first send a written Notice of Dispute ("Notice") to the other party by registered mail. The Notice to the Company or the Indemnified Party should be sent to the "Notice Address" which will be made available through email channels. The Notice must: (a) describe the nature and basis of the claim or dispute and (b) specify the specific demand. If you do not resolve the dispute with the Company or the Indemnified Party within 60 calendar days of receipt of the Notice, you or the Company or the Indemnified Party, as the case may be, may commence arbitration. During arbitration, the amount of any settlement proposal made by either party will not be disclosed to the arbitrator until the arbitrator has determined the amount, if any, to which you or the Company is entitled.
